These Terms & Conditions (“Terms”) govern the WooCommerce maintenance and care plan services (“Services”) provided by Atomweb (“we,” “I,” “us”), operated by Eliana Alexandra Alvarado Guillen, to you (“Client,” “you”). By purchasing a care plan, you agree to these Terms.
1. Services included in your plan
Each care plan covers one (1) WordPress/WooCommerce website and includes the services listed on the plan you purchased at atom-web.com, such as software updates tested on a staging environment, backups, security monitoring, uptime monitoring, checkout testing, performance optimization, product uploads and development hours, according to your plan tier.
Services begin after (a) payment is confirmed and (b) you provide the access described in Section 4. The first week of service (“Setup Week”) is dedicated to initial configuration: baseline backup, security hardening, staging setup, monitoring activation and a first update cycle.
2. Development hours & tasks
- Development hours included in your plan cover small tasks such as content changes, layout tweaks, plugin configuration, styling fixes and similar work.
- Larger projects — new features, redesigns, custom integrations, new page builds — are outside plan hours and will be quoted separately. Work on quoted projects begins only after your written approval.
- Unused development hours roll over for one (1) month and then expire. They have no cash value and are not refundable.
- Product uploads (“up to X products/month”) require you to provide the product content (images, descriptions, prices). Unused product slots follow the rollover policy stated on your plan, if any.
- Additional hours beyond your plan can be purchased at $50/hour, billed in 30-minute increments, always pre-approved by you.
3. What is not included
- Pre-existing malware or hacks: cleanup of sites that are already infected or compromised at onboarding is a separate one-time service, quoted after review (from $199).
- Hosting fees, domain registration, SSL certificates (when not free), premium plugin or theme licenses, and any third-party service fees. These remain your responsibility, though I can manage the renewals for you (see Section 6 regarding premium software updates).
- Content creation (copywriting, photography, graphic design), SEO campaigns, advertising management and email marketing, unless quoted separately.
- Issues caused by third parties: hosting outages, third-party service failures (payment gateways, CDNs, email providers), or changes made to the site by you or anyone else outside of Atomweb.
- Support for websites other than the one covered by your plan.
4. Access & credentials
- You agree to provide administrator access to your WordPress site and reasonable access to your hosting account. I recommend creating a dedicated administrator user rather than sharing personal passwords; instructions are provided during onboarding.
- You may revoke access at any time; however, Services cannot be performed without it, and paid time without access is not refundable.
- All credentials are stored securely, used only to provide the Services, and never shared with third parties.
5. Backups & restorations
- Backups are performed at the frequency defined by your plan and stored off-site.
- In case of failure, I will restore your site from the most recent healthy backup. Some data loss between the incident and the last backup is possible and is limited by your plan’s backup frequency.
- Backups are retained for 30 days. Upon cancellation, you may request a full copy of your latest backup within 14 days.
6. Updates, staging & site changes
- Updates are tested on a staging environment before being applied to your live site whenever your hosting environment allows it. If your hosting cannot support staging, I will inform you and recommend alternatives; in that case updates are applied with extra precautions (fresh backup immediately before updating).
- Premium plugins & themes: updating premium (paid) software requires an active license. You are responsible for providing valid license keys, vendor account access, or the updated files supplied by the vendor. If a license is expired or not provided, that plugin or theme will be excluded from update cycles, flagged in your reports, and any security or compatibility risk arising from it remains your responsibility. I can recommend free or lower-cost replacements when a license isn’t worth renewing.
- Despite testing, software updates can occasionally cause unexpected issues. If an update I applied breaks functionality, fixing it is included in your plan at no extra cost.
- Emergency work caused by changes made by you or third parties may consume plan hours or be quoted separately.
7. Support & response times
- Support is provided in writing by email during business days (Monday–Friday). Target first-response times are those listed on your plan (24h / 12h / 4h, business hours).
- Response time targets are goals, not guaranteed resolution times; complex issues may take longer to fully resolve, and I will keep you informed of progress.
8. Payments, renewals & price changes
- Plans are billed in advance, monthly or annually, in USD, via 2Checkout (Verifone), our authorized reseller and payment processor. Your subscription renews automatically until cancelled.
- If a payment fails, I will notify you. Services pause if payment remains outstanding for 7 days, and may be terminated after 21 days.
- Prices may change with at least 30 days’ written notice. Price changes never apply retroactively to time already paid.
9. 30-day money-back guarantee
If you are not satisfied within the first 30 days of your first subscription, email me within that period and I will refund your first payment in full. The guarantee applies once per client and site, covers the first billing cycle only, and does not cover separately quoted one-time services already delivered. 10. Cancellation
- No contracts, no minimum term. You may cancel anytime by email to info@atom-web.com.
- Cancellation takes effect at the end of your current paid period. Monthly payments already made are not prorated; annual plans cancelled after the 30-day guarantee are refunded for full unused months minus two months (reflecting the annual discount received).
- Upon cancellation, I will remove my access, hand over any credentials created for the Services, and provide your latest backup upon request. Your site always remains 100% yours — every plugin, configuration and improvement stays with you.
- I may terminate service with 30 days’ notice, or immediately in cases of abusive behavior, illegal content, or non-payment, refunding any unused full months.
11. Client responsibilities
- You confirm that you own or are authorized to manage the website, and that its content and business activity are lawful.
- You agree to keep your contact email current, review monthly reports, and respond to requests that require your decision (e.g., approving larger fixes).
- You are responsible for your store’s legal compliance (privacy policy, consumer law, tax settings, PCI obligations of your payment provider).
12. Limitation of liability
I will always act with professional care and industry best practices. However, to the maximum extent permitted by law: the Services are provided “as is”; I am not liable for indirect or consequential damages, including lost sales, lost profits or lost data caused by events outside my control (hosting failures, third-party software defects, attacks exploiting previously unknown vulnerabilities, force majeure); and in any case, total liability is limited to the amount you paid for the Services in the three (3) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Confidentiality & privacy
Any non-public information about your business obtained while providing the Services is treated as confidential. Your customers’ personal data is accessed only when strictly necessary for maintenance tasks and is never copied, sold or used for any other purpose. 14. Portfolio use
I may mention your store name and display non-confidential results (e.g., speed improvements) in my portfolio and marketing. If you prefer full confidentiality, email me and your project will be excluded — no questions asked.
15. General
These Terms are governed by the laws of [Your Country/State]. If any provision is found unenforceable, the rest remain in effect. These Terms, together with your plan description at purchase, are the entire agreement. I may update these Terms with 30 days’ notice for material changes; continued use of the Services after that constitutes acceptance.
